We take great pride in making our products and ensuring our users are happy. We are pleased to offer a limited warranty (the “warranty”) on our Fusion Guard® cookware to the consumer who originally purchased the product (“you”) from an authorized retail partner or directly from the Fusion Guard online store(s).
WHAT DOES THE WARRANTY COVER?
Your Fusion Guard® cookware is warranted to be free of defects in material, construction and workmanship with normal home use when following the care and instructions, for one (1) year from the date of original purchase. The manufacturer agrees, at its option during the warranty period, to repair any defect in material or workmanship or to furnish a repaired or refurbished product of equal value in exchange without charge (except for a fee for shipping, handling, packing, return postage, and insurance which will be incurred by the customer). Such repair or replacement is subject to verification of the defect or malfunction and proof of purchase as confirmed by showing the model number on original dated sales receipt. Owner must provide normal maintenance and proper care of the product according to generally accepted standards. Shipping and handling fees, if needed, are to be paid for by the customer.
WHAT DOES THE WARRANTY NOT COVER?
The warranty does not apply to damage caused by:
(a) improper use;
(b) if the cookware is subjected to blows, shocks or falls;
(c) failure to follow product instructions;
(d) normal wear and tear such as stains, discoloration, or scratches;
(e) modifications;
(f) loss or damage in transit;
(g) accidents or other actions beyond our reasonable control;
(h) damage, such as dents or scratches, to the rim of the product caused by sharp
non-safe utensils, utensil impacts or stacking during storage;
(i) damage caused by the use of appliances such as mixers or the use of improper
cleaners including scouring pads, steel wool, abrasive cleaners not rated for use on
non-stick surfaces, or harsh chemicals such as bleach or other non-rated or
recommended products; or
(j) usage in a commercial, professional or workplace setting or for any non- intended
purpose;
(k) dissatisfaction due to buyer’s remorse;
(l) insect or animal damage;
(m) loss or damage caused by acts of God; or
(n) any defect caused by or worsened by negligence, improper maintenance, lack of
maintenance, improper action or inaction, or willful or malicious acts by you or any
party other than the Company, its employees, agents, or contractors.
Note: The presence of scratches, discoloration, and stains from daily non-commercial use will not affect the use of the product or cause any safety concerns and are not covered under the terms and conditions of this warranty.
WILL THE COOKWARE BE REPLACED IF DEFECTIVE?
If the product has a defect during the applicable warranty period we will, upon examination of the product, at our sole discretion reserve the right to, either repair or replace the product.
HOW DO YOU APPLY THE WARRANTY?
To facilitate an easier process later if your cookware were to need it, you should register your product below right after you make your purchase:
Should your cookware fail to perform as stated or should you be needing support during the product warranty period, please contact our Customer Support team by e-mail at customerservice@fusionguardcook.com. Make sure you have and store the original receipt as proof of purchase. This is required for the warranty to document the date of purchase and to confirm that you are the original purchaser. If you are calling in, make sure to also have the product in hand, so we may better assist you. Claims for defective merchandise must be made within 1 year from invoice date. Claims for missing parts must be made within 30 calendar days after the merchandise is received. Any claim for defective merchandise returns must be packed in original packaging. We reserve the right to specify that items be returned to the original warehouse for inspection or be inspected by our representative in the field. Pictures are required to claim defective merchandise, along with a copy of the original invoice. If the claim is justified, the item(s) or part(s) will be repaired, replaced or a credit will be issued. Should it be determined by our specialists that the cookware needs to be replaced, we will send you, the customer, a return shipping label (with corresponding RMA) to send the faulty unit back to us and cover the inbound costs for the shipping. A fee of $15 to $25 (subject to change) will be charged at the time, to cover the cost of shipping and handling for the replacement unit.
LIMITATION OF LIABILITY
The remedies described above are your sole and exclusive remedies and our entire liability for any breach of this warranty. We limit the duration and remedies of all implied warranties to the duration of this express warranty. Some states do not allow limitations on how long an implied warranty lasts, so the preceding limitation may not apply to you. Our liability will under no circumstances exceed the actual amount paid by you for the product. We will not under any circumstances be liable for any consequential, incidental, special, or punitive damages or losses. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the preceding limitation or exclusion may not apply to you.
HOW DOES STATE LAW APPLY?
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Check your local state’s rules for more details.
